Terms of Service

These Terms govern your access to and use of KeySnapshots and establish the legal terms applicable to photographer accounts, customer gallery access, purchases, subscriptions, content uploads, and related platform functionality.

They include important information regarding billing, prohibited conduct, intellectual property, warranty disclaimers, limitations of liability, dispute resolution, and other legal rights and obligations.

1. Overview and Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and KeySnapshots governing your access to and use of the Services.

By accessing or using the Services, creating an account, redeeming a gallery code, purchasing products, or clicking to accept these Terms, you agree to be bound by these Terms and our related policies.

2. Consent to Electronic Communications

By providing contact information to KeySnapshots, you consent to receive communications from us electronically, including by email and, where you provide a phone number, by call or text message, to the extent permitted by law.

3. Subscriptions, Billing, and Renewals

Certain photographer-facing features of the Services are offered on a paid subscription basis. By purchasing a subscription, you authorize KeySnapshots and its third-party payment processors to charge the payment method associated with your account for subscription fees, taxes, and any other amounts due in connection with your use of the Services.

4. Eligibility, Registration, and Account Security

You must be legally capable of entering into a binding agreement in order to use the Services.

You are solely responsible for safeguarding your account credentials and for all activities occurring under your account.

5. Access to and Use of the Services

Subject to your compliance with these Terms, KeySnapshots grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Services.

  • use the Services only in compliance with applicable law and these Terms;
  • maintain all equipment, software, and internet access necessary to use the Services;
  • ensure that your use of the Services does not interfere with or degrade the experience of other users.

6. Acceptable Use and Prohibited Conduct

You may not access or use the Services in any manner that is unlawful, infringing, fraudulent, deceptive, threatening, abusive, defamatory, obscene, invasive of privacy, or otherwise objectionable.

You agree not to engage in any activity that could compromise the security, availability, or integrity of the Services.

7. Photographer Services and Customer Transactions

KeySnapshots makes photographer-oriented tools available to facilitate gallery creation, redemption workflows, access management, digital delivery, ecommerce, and related customer experiences.

Photographers are solely responsible for determining what content they upload, what customers may access, what products or services are offered, and whether all necessary permissions and rights have been obtained.

8. Orders, Payments, and Fulfillment

The Services may allow customers to purchase digital downloads, prints, packages, or other products and services. All orders are subject to acceptance, availability, pricing accuracy, payment authorization, fraud review, and any other validation criteria.

9. User Content and Rights You Grant to KeySnapshots

You retain ownership of photographs, videos, text, graphics, logos, metadata, gallery information, and other content you upload through the Services.

You grant KeySnapshots a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, format, adapt, transmit, display, perform, distribute, and otherwise use User Content as necessary to provide, operate, secure, improve, and support the Services.

10. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND.

KEYSNAPSHOTS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KEYSNAPSHOTS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNTS PAID BY YOU TO KEYSNAPSHOTS DURING THE SIX MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS.

12. General Terms

These Terms, together with any additional terms, policies, order forms, pricing terms, and other documents incorporated by reference, constitute the entire agreement between you and KeySnapshots regarding the Services.
